    promote teamwork and the knowledge that if both the individual and the Office work together individual success will be achieved both academically and personally For this to happen the individual and the Office of Adaptive Services need to understand their rights and responsibilities Individual s Rights It is the right of the individual to obtain services and accommodations so that he or she will have equal opportunity and access to succeed academically as his or her peers It is also the right of the individual to expect these services and accommodations to be respectful and that his or her learning differences are seen as differences and not as a cause for loss of integrity and self esteem Rights of the Office of Adaptive Services It is the right of the Office of Adaptive Services to help maintain the academic standards set by FGCU and as a result limit or deny accommodations and services that pose a direct threat to students faculty and staff limits or alters the programs so that the academic standards are lessened and or financially burdens the institution It is also the right of the Office of Adaptive Services to limit or deny those services that are not in conjunction with the documentation Finally it is the right of the Office of Adaptive Services to request additional documentation if the documentation presented is insufficient for providing services and accommodations Individual s Responsibility It is the responsibility of the individual to provide proper documentation express problems or concerns with the Office of Adaptive Services request accommodations and services as needed and take advantage of those services that are provided It is also the responsibility of the individual to maintain FGCU s academic standards and comply with the rules and regulations that have been formed for all individuals to

    coverage that is received The K 12 system is covered under the Individuals with Disabilities Education Act IDEA while higher education is covered under the Americans with Disabilities Act ADA Even though both are covered under the blanket of Section 504 of the Rehabilitation Act each law is specific to the rights and responsibilities of those with a disability The below is a general comparison of the two laws and what a student with a disability entering FGCU should expect regarding their rights and responsibilities IDEA ADA Statute Ensures free and appropriate public education for children with disabilities Protects Individuals with disabilities from discrimination by providing equivalent access to programs and services Coverage Children in the K 12 system whose education is negatively impacted by the disability There are specific disabilities covered so not all students with disabilities will be protected Any person with a physical or mental impairment that substantially limits one or more major life activities Initiating Services Parents and teachers identify students needing assistance through consent for evaluation and Child Find Students must self identify as an individual needing assistance due to a disabilty by supplying the appropriate documentation from a qualified evaluator Documentation School districts are

    590 7975 Email adaptive fgcu edu Documentation Individuals requesting accommodations and services due to a disability may be asked to provide documentation to support their requests Our Minimum Documentation Requirements form provides information on the required documentation for receiving services link to form Individualized Education Plans IEP 504 plans and former teacher recommendations are helpful in eliciting services but these types of documentation ARE NOT sufficient for primary documentation In addition if documentation presented exceeds a reasonable time period typically 3 5 years current testing may be required and students will be referred to the Counseling and Psychological Services office CAPS with the cost of the testing being at the expense of the individual Students may also choose to test privately and a referral list of local offices who conduct disability testing can be obtained through Adaptive Services Process to Receive Services 1 Students will need to make an appointment with their case manager in order to formulate an accommodation plan Documentation of the request should be supplied prior to the appointment and it is also recommended that the Request for Accommodations form be completed prior to the appointment link to form 2 Students should meet with the assigned case manager in Adaptive Services within the first two weeks of the start of classes although it is recommended that the student make the appointment during the orientation period Discussions during this meeting will allow the case manager to modify the accommodations and services if the need arises 3 If the status of a student s condition changes in any way additional documentation regarding the change will be required This documentation must be sent to the case manager as soon as the change in condition is discovered 4 It is recommended that the student meet with the assigned case manager at

    fgcu edu Confidentiality The Office of Adaptive Services strictly adheres to confidentiality guidelines Individuals who receive services will do so on the premise that only the individual office staff and in some cases instructors are aware of this partnership The following details the confidentiality guidelines Documentation is kept in a locked cabinet and is available only to the office staff The individual has the right to review his or her file upon request but the file is not allowed to leave the Office Instructors and other faculty and staff are on a need to know basis Individual files will not be made public to those that work at FGCU Documentation is not given to instructors and instructors are only made aware of the accommodations that will be needed while in the classroom The Office of Adaptive Services STRONGLY suggests that the individual make contact with his or her instructor and maintain a student teacher relationship with him or her However it is the decision of the individual whether or not the instructor is made aware of the individualized need Tutors note takers and other volunteers who will help provide services are also on a need to know basis Their primary goal is to tutor or take notes It is the decision of the individual whether or not these service providers are made aware of the individualized need Testing accommodations will be handled in such a fashion that the individual and the instructor are the only ones who know about the accommodation The Office of Adaptive Services strives to maintain confidentiality throughout this process In accordance with the Family Education Rights and Privacy Act of 1974 FERPA all information regarding the individual s acquired services accommodations testing circumstances and grades are ONLY seen by the office staff and the student The

    239 590 7975 Email adaptive fgcu edu Accommodations Adaptive Services provides the following accommodations and services This list is not inclusive and other accommodations and services can be provided according to individual need Note takers Tutoring Extended time on tests Standard Time and Minimal distraction testing environment Readers for tests Books in alternate format Adaptive technologies i e Dragon JAWS Kurzweil Zoomtext Recording of lectures Instruction in study strategies Sign Language Interpreters The assigned case manager determines what accommodations an individual will receive based on the documentation provided and conversations with the individual Other accommodations may be considered based on the individual s past experiences and benefits from such an accommodation It is the individual s responsibility to notify their case manager if there are any problems with the services such as mechanical problems being serviced in the classroom etc It is the case manager s responsibility to make sure that the accommodation is fixed or available at the appropriate times It is not the responsibility of the case manager or Adaptive Services to make sure that the individual is using the accommodations The accommodations that are offered are not the magic trick to success They are available in order to supplement the individual s strengths and aid in combating the individual s weaknesses Adaptive Services is not responsible for academic failure when the individual does not take advantage of the services that are offered Reasonable Accommodation Reasonable accommodation is an accommodation that does not pose a burden or threat either financially or physically to the institution or the parties involved In addition it is an accommodation that will not alter the fundamental nature and or requirements of the program or institution The case manager will determine what accommodations and services will be deemed as unreasonable Course Substitution Course substitutions
