    Library Departments Public Services Government Documents Government Documents Reference Library Instruction Periodicals Electronic Resources Interlibrary Loan Government Documents Collection Development Policy Congressional Documents Constitution Day Documents Online Finding Aids Statistical Sources Online Administrative Tools Contact Info Reference Librarians 508 565 1203 phone 508 709 0223 text reference stonehill edu Jane Swiszcz Government Documents Librarian 508 565 1452 phone jswiszcz stonehill edu Connect with the MacPháidín Library Transformation via Discovery Explore Evaluate Engage What are Government Documents Government Documents is the official term given to materials received through the Federal Library Depository Program They are official documents published by Federal agencies from three branches of the Federal Government Included is legislative materials such as Congressional hearings and reports statistical information and publications from various Federal agencies and decisions from the United States Supreme Court The Government Documents Collection The MacPháidín Library has been a participant in the U S Federal Depository Library Program since 1962 Stonehill College in cooperation with the United States Government serves the campus and the surrounding communities as a selective Government Depository A selective depositories is not required to receive all U S Government publications which are made available to depositories The library currently receives approximately 19 of the available items for selection from the Government Printing Office Each week the library receives publications in paper microfiche or electronic format CD ROM or video Many of the publications are now available online and can be found by searching HillSearch accessing the agency website or using a search engine to locate the document The focus of the MacPháidín Library collection is Census and Demographics Crime Criminal Justice and Law Enforcement Education Health Legislation Regulations Statistical Data and Research Supreme Court Paper documents are located on the second floor of the library Microfiche items are shelved in the microforms

    as criticism comment news reporting teaching including multiple copies for classroom use scholarship or research is not an infringement of copyright In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include 1 the purpose and character of the use including whether such use is of a commercial nature or is for nonprofit educational purposes 2 the nature of the copyrighted work 3 the amount and substantiality of the portion used in relation to the copyrighted work as a whole and 4 the effect of the use upon the potential market for or value of the copyrighted work The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors Fair use is determined on a case by case basis To determine if something would be considered fair use you need to consider each of the four factors A preponderance of factors should support the claim to fair use The college has a standard check list available to help you decide of you are making fair use of copyrighted material Purpose and character Fair use allows copying to support teaching at a non profit institution so this factor would always count in favor of fair use for course related materials This also covers a copy you make for yourself to use in your research Fair use covers research and teaching but not scholarly publication You would need permission to include copyrighted material such as photographs when you publish an article or book Nature of the material A claim of fair use is stronger for an academic article or other non fiction than for creative artistic works Amount and substantiality The law does not explicitly quantify how much may be used or for how long a The widely cited guide or safe harbor limits copying to no more than 10 of a publication although fair use usually extends beyond this However a very small portion well under 10 that contains the essence of the whole work may be held to violate the substantiality limit if it harms the market for a work b Although the law does not explicitly mention how long or how often something may be used for teaching it is generally accepted that a copy should only be used for as long as necessary to meet instructional needs in a course c There is no explicit limit on repeated use of a copy The safe harbor for repeated use is to obtain permission if something is used for more than one semester e g each time the course is offered Effect on the potential market for a work You are not allowed to copy and distribute an entire book even if it is out of print a standardized test or a workbook Publications that are intended to be consumable cannot be copied and distributed under the principle of fair
